Terms of Service

These Terms of Service (the "Agreement") govern your access to and use of Phone Simulator (the "Service"), operated under Kobaltstack LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.

License

Subject to your compliance with this Agreement, we grant you a revocable, non-exclusive, non-transferable, limited license to access and use Phone Simulator for its intended purpose.

Restrictions

You agree not to, and will not permit others to:

• Resell, sublicense, rent, lease, or otherwise commercially exploit the Service without our prior written consent
• Modify, reverse engineer, decompile, or create derivative works based on the Service
• Remove or alter any proprietary notices on the Service

Accounts and subscriptions

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Subscription plans, pricing, and billing cycles are as described within Phone Simulator at the time of purchase. We reserve the right to change pricing on a going-forward basis with reasonable notice.

Your feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or compensation to you.

Third-party services

The Service may link to or integrate with third-party services. We are not responsible for the content, accuracy, or practices of any third-party services, and your use of them is at your own risk and subject to their own terms.

Intellectual property

The Service and its content, features, and functionality are owned by Kobaltstack LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written permission, except as expressly permitted by this Agreement.

Term and termination

This Agreement remains in effect until terminated by you or by us. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate this Agreement. Upon termination, your right to use the Service ends immediately.

Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or fully secure.

Limitation of liability

To the maximum extent permitted by law, Kobaltstack LLC's total liability arising out of or relating to this Agreement or the Service will not exceed the amount you paid for the Service in the preceding 12 months. We will not be liable for indirect, incidental, special, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless Kobaltstack LLC and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of this Agreement.

Governing law and disputes

This Agreement is governed by the laws applicable to Kobaltstack LLC, without regard to conflict-of-law principles. Any dispute arising from this Agreement will first be addressed through informal negotiation by contacting us at support@phone-simulator.com. If unresolved within 60 days, either party may pursue the dispute through binding arbitration or another mutually agreed process.

Changes to these terms

We may update this Agreement from time to time. Material changes will be communicated with reasonable advance notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated terms.

Entire agreement

This Agreement, together with our Privacy Policy and Refund Policy, constitutes the entire agreement between you and Kobaltstack LLC regarding Phone Simulator and supersedes any prior agreements on this subject.
